XARELTO LITIGATION UPDATE

I recently attended a National conference which included an update on the Xarelto litigation. Following is an update on the Xarelto MDL;

The litigation was consolidated as MDL No. 2592 in the Eastern District of Louisiana. The Honorable Eldon E. Fallon is the presiding judge. As of April there are over 4,500 pending claims in the Xarelto MDL.

The litigation is moving forward and the process is ongoing. Over 3.9 millions documents have been produced since document production began in April 2015. The depositions of current and former employees of Bayer and Janssen are ongoing. Thirteen depositions have been completed and additional depositions are set to begin this month.

We also waiting third party discovery from the FDA and the DCRI (Duke Clinical Research Institute). Dates have been set for the first four bellwether cases as follows;

February 6, 2017 (Eastern District of Louisiana case)

March 13, 2017 (Eastern District of Louisiana case)

April 24, 2017 (Mississippi case) and

May 30, 2017 (Texas case).

The four cases that will be tried will be selected by August 1, 2016 from the forty bellwether cases selected on January 11, 2016 and will be worked up for trial.

Sarah Showard graduated from the University of Maryland in 1985, Magna Cum Laude with a Bachelor of Arts in English-Linguistics and a Certification in Women's Studies. She then graduated from New York University School of Law in 1988. Sarah began practice initially as an insurance defense attorney, and has been representing plaintiffs since 1990. Sarah has a son, Benjamin, who recently graduated from The Gregory School and will attend ASU in the fall, with future plans to attend law school and eventually join Showard Law Firm.
