Bayer Wins Dismissal Of Four New Jersey Mirena Lawsuits

A New Jersey state judge has dismissed four women's lawsuits in multi-county litigation over Bayer HealthCare's intrauterine device Mirena.  The women who claimed the devices perforated their uteruses filed the lawsuits too late to meet the product liability deadline.  The judge held that the statute of limitations started to run when the women learned that the IUDs were no longer in their uteruses rather than when they learned that the reason for the migration was a defect in the product.  In many cases this significantly reduces the time within which to file and may impact hundreds of additional cases.
